Understanding Gratuity Calculation Formula
The calculation formula is based on UAE labour law.
For Unlimited Contract Employees
If you resign yourself, calculation differs based on service period.
For 1 to 5 Years Service: • You get 21 days salary for each year completed • Formula: Basic Salary ÷ 30 × 21 × Years
For More than 5 Years Service: • First 5 years: 21 days salary per year • After 5 years: 30 days salary per year • Formula: (Basic Salary ÷ 30 × 21 × 5) + (Basic Salary ÷ 30 × 30 × Remaining Years)
If employer terminates you, same calculation applies for full gratuity.
For Limited Contract Employees
Contract Completion: • You get 21 days salary for each year completed • Full gratuity paid regardless of who ends contract
Early Resignation: • Less than 1 year: No gratuity • 1 to 3 years: One third of total gratuity • 3 to 5 years: Two third of total gratuity • More than 5 years: Full gratuity amount
Important Calculation Points
Maximum Gratuity Limit: • Total gratuity cannot exceed 2 years basic salary • This is maximum cap set by UAE law
Daily Salary Calculation: • Your daily salary = Monthly Basic Salary ÷ 30 • Only basic salary counts, not total package
Documents Required
You need some documents to claim gratuity from your employer. Keep all these ready during resignation process.
• Original employment contract with salary details • Passport copy with UAE residence visa page • Emirates ID card for verification purpose • Last 3 months salary slips or certificates • Resignation acceptance letter from company • Labour card copy issued by MOHRE • Bank account details for transfer payment • Exit clearance documents from employer
All documents should be clear and complete. Submit these to HR department when processing exit formalities. Make sure contract shows your correct basic salary. Keep copies of all documents for your records and future reference.

- Must work in UAE private sector company
- Employment contract registered with MOHRE needed
- Completed proper resignation or exit process
- Basic salary clearly mentioned in contract
